Please read the terms and conditions carefully before placing your order with Lazy Beds. Lazy Beds, may change, at its discretion, modify, add or remove these terms and conditions at any time and therefore it is important to read these each time you make a purchase order.

Terms & Conditions of Sale
All orders are accepted and executed on the understanding that the Purchaser is bound by the following conditions of sale, which shall constitute a binding contract, except where specifically varied in writing. In the event of the customer’s order containing conditions contrary to these conditions of sale they are not accepted without written consent from Lazy Beds. The words "our web site" refers to www.lazybeds.co.uk

Orders
Orders placed via our web site and by telephone will be treated as firm orders and processed accordingly.

Price
Prices shown on our web site are in UK Sterling. Lazy Beds reserve the right to vary prices without notice and to charge the Purchaser the price ruling at date of dispatch. All prices on the product pages are shown inclusive of VAT.

Description of Products
Lazy Beds may make changes in the specification of the Products which do not materially affect their quality or performance required to conform with any applicable statutory requirements where the Products are supplied to Lazy Beds’s specification.
Photographs provided on our web site are for illustrative purposes only and may not exactly match the Product itself. Colours in photographs provided on our web site are for guidance only.

Delivery
Every endeavour will be made to maintain delivery dates but no responsibility for later delivery due to circumstances beyond our control will be accepted. Delay will not be a ground for rejecting goods or terminating the contract. Lazy Beds accepts no responsibility for any consequences, financial or otherwise, for failure of the customer to receive goods at the delivery address provided by the customer. The Products the Buyer orders will be delivered to the address specified in the order unless otherwise agreed in writing by the Buyer and Lazy Beds. Goods will be deemed to have been delivered once delivered to the specified address and Lazy Beds will not be liable to the Buyer for non-delivery of the Products. Lazy Beds does not need to satisfy itself that the person accepting delivery at the specified address is the Buyer (or authorized by the Buyer to accept delivery of the Goods). Goods delivered by carrier will require a signature to acknowledge receipt of the goods. Check that the number of boxes as stated on the drivers manifest matches the number of boxes being delivered, if it does not then just sign for the number of boxes received in good condition. If you are not able to fully examine the goods then you must sign as ‘UNEXAMINED’. If the goods are delivered and appear not in good condition, they must be signed for as ‘DAMAGED’ or rejected (where they will be returned by to Lazy Beds by the carrier).  If you sign for the goods in good condition then you are confirming that the goods are not damaged. Once you sign for the goods in good condition then neither you or us can claim against the carrier for damage, so you must be sure before you sign. Once signed for in good condition Lazy Beds will accept no responsibility for subsequent claims in respect of damaged goods. In the event of goods being returned to Lazy Beds because of failure by the customer to receive the goods, the customer will be liable for the costs incurred in returning the goods to Lazy Beds. No re-delivery will be made until the customer has paid for the cost of a second delivery and reimbursed Lazy Beds for the cost of returning the goods to Lazy Beds

Unless otherwise agreed in writing by yourself and Lazybeds, the delivery of the Goods will take place at the address you have specified in the order (if the Goods are to be delivered to another address other than the registered cardholder address, proof of address will be required).

Provided that we deliver the Goods to the address you have specified in the order (or any other address agreed by Lazybeds) then the goods will be deemed to have been delivered and we will not be liable to you for non-delivery of the goods. We do not have to satisfy ourselves that the person who accepts delivery at the address you have provided is you (or is a person authorised by you to accept delivery of the Goods).

Any dates and times quoted for delivery of the Goods are approximate only. The Goods may be delivered to you in advance of any estimated delivery time, giving you reasonable notice.

Goods delivered by Lazybeds or by a third party contracted to undertake delivery on our behalf are delivered only to the inside of your doorstep. If you request that Goods are taken inside your property, or request any assistance with moving or assembly of items, then we or any third party contractor shall not be held liable or responsible for any damage to carpets, fixtures, fittings or the structure of your accommodation (e.g. plasterwork, brickwork) that may occur. It is at the customer's risk. Such an action is undertaken solely on your individual responsibility. Please note that any claims for damages arising from the above must be claimed with the buyers own insurance. Lazybeds will not be held liable.

Please note that all the above deliveries are subject to good road/weather conditions. Lazybeds cannot be held responsible for road closures, accidents and adverse weather conditions, that delay your delivery.

When a delivery date has been arranged with the customer and our delivery team arrive and the customer is not present to receive delivery, Lazybeds reserves the right to charge the customer a minimum of £70 to cover the cost of the failed delivery.

Please note that if you request a call prior to delivery, this cannot be guaranteed. Our delivery times are outlined above.

Delivery without a signature - Please be aware that Lazybeds and our contracted delivery teams require a signature at time of delivery. However, if you are unable to be present at time of delivery and you request the goods to be left with a neighbour or in a safe place, Lazybeds will do so with the presence of a signed note from the customer stating to that effect. Upon delivery, the driver will take the note as proof of doing so. If goods are left at customers request and upon returning to the property find that the goods are not present, Lazybeds will not be held reliable or responsible. This is undertaken at the risk of the customer.

Please note that many of our products/furniture are flat packed for home/self assembly. It is the responsibility of the customer to assemble the items or arrange for a competent third party to do so at their own expense.

Please be aware that Lazybeds will not be liable to pay any form of compensation for late or failed deliveries. This also includes time taken off work to accept delivery or loss of income for rental properties.

If you are purchasing a replacement bed or mattress, Lazybeds strongly recommend that you DO NOT dispose of your old items until delivery of the new goods has been made.

Please note: Colours may vary in shade as there are many shades of blues, blacks, pinks, browns and especially white.

Please ensure when purchasing an item from Lazybeds, that if you require any information regarding sizes and dimensions, you ask before placing your order. If you wish to return any items that are delivered that do not fit your requirements, there will be a returns fee of £70 payable to cover delivery/collection and administration costs.

If you wish to cancel an order after the delivery has been missed, at the time of delivery by returning the goods with the delivery driver or whilst your item is out for delivery, a £70 cancelation fee will apply.

If you are asking for a refund because you have cancelled the order however, there is a charge of £70 per order this is to cover the cost of delivery and collection fee. We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

Please research your product before buying from our site. No refunds or exchanges will be authorised if products are found cheaper after delivery has been accepted. Unwanted goods/wrongly ordered:

Goods will be collected at a charge of £70 per order. If you require an exchange there will also be a redelivery charge of £70. Goods must be returned in the original packaging they arrived in, in order to be collected. Please note: The items will not be collected if they are not safely or sufficiently packed.

Any mattresses received that are vacuum packed (rolled up), if you find that the mattress is not suitable, we would kindly ask for you to contact us and we will send you a mattress bag and to not to use it and re-wrap ready for collection or exchange.

All the firmness ratings advertised on our site for mattresses are given by us and are based on comparison of the different products we sell, if you wish to return an item due to it not meeting your firmness rating expectation a collection fee will be applicable of £70 per order.

Cancellation & Returns
If you cancel your order in writing before Lazy Beds have dispatched it then Lazy Beds will quickly refund your payment in full and cancel your order. If you wish to return an item please call us on 01274 742424 to authorise the return. Non authorised returns may be rejected.

General Returns
We are happy to accept return of goods in their original packaging only, and if in perfect condition and at the buyer’s cost. The original carriage charge will also not be credited, subject to the following...
All sales are final and we do not supply goods on a trial or sale or return basis.  However, you are entitled to cancel your order within 7 days from delivery of the goods for a full credit or refund less any applicable delivery charges providing:
A) The goods must be unused and ‘as new’ in their original packaging including all manuals and accessories and the packaging must be in pristine condition, you must not puncture, cut or remove the plastic covering on a mattress or divan bed (for hygienic reasons) .
Please note: "Unused" means unused, it doesn’t mean opened, used for a few days and then reboxed. 
B) Any items with broken security seals or have been unpacked from their original packaging will be deemed "used" and will not qualify for a refund or credit.
C) You must notify us within 7 days from date of delivery of your intention to return the goods IN WRITING (including by email).  We will acknowledge this by email and your goods must be received by us within 14 days of this acknowledgement.  During this period it is your responsibility to return the goods to us at your own cost and risk.  We will not accept any goods back after this 14 day period. 
If goods are received back with missing or used consumables or accessories, the cost of the accessories will be charged to you or we may reject the return entirely.
Goods received back in any condition other than ‘as new’ will be returned back to you at your cost or made available for you to collect. We are able to offer a collection service at £70 if required.

Faulty Returns
Should an item fail or develop a fault please contact us as soon as possible as many "faults" can be resolved quickly over the telephone. If the item needs to be returned you must return the faulty item directly yourself.  When the goods have been received, inspected and found to be faulty we will despatch a replacement item to you as soon as possible. If the item is not found to be faulty it will be returned to you at your cost.
This returns policy does not affect your legal rights.

Claims
Unless claims for shortages or damage are notified in writing to the carrier (by signing for the goods as 'DAMAGED'), and Lazy Beds within three days of receipt no liability will be accepted by Lazy Beds. In the event of non-delivery Lazy Beds must be advised in writing within ten days from placing the order.

Payment
Payment is to be made prior to goods being dispatched either directly on our web site or by telephone.  We accept most credit and debit cards.

Ownership
The ownership of the goods shall remain with Lazy Beds until such time as all sums owing to Lazy Beds whether under this contract or any other contract have been paid.

Limited Liability
Any liability which we may incur to you in contract or tort (including liability in negligence) arising out of or as a result of: Any failure to supply or deliver goods; Any delay in delivery of goods; Any defect in any goods or service; shall be limited to the purchase price of the goods in question.
Your statutory rights are not affected.

Liability to Third Parties
You shall indemnify us in respect of any liability and all losses, costs, charges and expenses which we may suffer or incur by reason of any claim (including for liability in negligence) made by third parties in respect of or arising out of the state, conditions or use of goods (including, without limitations, goods resold to third parties whether or not despatched directly to third parties at your request) or in any other way relating to the goods.

Proper Law of Contract
The Contract shall be governed by the law of England and Wales and any dispute, question or remedy however-so arising determined exclusively by the Courts of England and Wales.

Force Majeure
These conditions of sale shall be construed in accordance with the laws of England and if any question, dispute or difference shall arise between the parties in respect of their interpretation, the same shall be referred by agreement to a single arbitrator otherwise it shall be referred to arbitration under the provisions also being applicable to the case of reference to a single arbitrator.
We shall incur no liability for failure to perform our obligations thereunder due to the existence of circumstances which we have not caused and which are beyond our control.

Data Protection
Lazy Beds will take all reasonable precautions to keep the details of the Buyer's order and payment secure but unless Lazy Beds is negligent, Lazy Beds will not be liable for unauthorized access to information supplied by the Buyer.

By placing an order with Lazy Beds you agree to be bound by the above Terms and Conditions.

All information and advice on our web site is provided in good faith. Lazy Beds cannot be held liable for any inaccuracies or losses incurred should you act upon this information or advice.
